# TERMS OF SERVICE

These Terms of Service ("Agreement") constitute a legally binding contract between you ("Customer," "you," or "your") and Vista View Realty Services LLC, a Texas limited liability company ("VistaView," "Company," "we," "us," or "our"), governing your access to and use of the VistaView Property & Entity Intelligence Platform, including all associated data feeds, APIs, dashboards, reports, and related services (collectively, the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you are entering into this Agreement on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these terms.

## 1. DEFINITIONS

**1.1** "Authorized Users" means the individuals within Customer's organization who are permitted to access and use the Service under Customer's subscription.

**1.2** "Derived Intelligence" means any analytics, scores, indices, materialized views, risk assessments, aggregated datasets, cross-referenced outputs, or other value-added data products created by VistaView through its proprietary processing of Government Data.

**1.3** "Government Data" means data sourced from official United States federal, state, and local government public records, including but not limited to the data sources enumerated in Section 3.2.

**1.4** "Platform" means the VistaView web application, APIs, data feeds, dashboards, reporting tools, and all related technology infrastructure operated by VistaView.

**1.5** "Subscription" means the specific service tier, data access level, and usage parameters agreed upon between Customer and VistaView, as set forth in the applicable Order Form or subscription agreement.

## 2. SERVICE DESCRIPTION

**2.1 Overview.** VistaView operates a Business-to-Business ("B2B") Property & Entity Intelligence Platform that aggregates, normalizes, enriches, and delivers data sourced exclusively from official United States government public records. The Platform provides institutional-grade intelligence for property valuation, entity verification, risk assessment, regulatory compliance, and market analysis.

**2.2 Target Customers.** The Service is designed for and marketed to business and institutional customers, including but not limited to:

- (a) Banks and financial institutions
- (b) Insurance companies and underwriters
- (c) Hedge funds and investment firms
- (d) Title companies and title insurance underwriters
- (e) Licensed real estate appraisers and appraisal management companies
- (f) Oil and gas companies
- (g) Land survey companies
- (h) Mortgage lenders and servicers
- (i) Government-sponsored enterprises
- (j) Regulatory and compliance departments
- (k) Real estate investment trusts (REITs)
- (l) Private equity firms with real asset portfolios
- (m) Law firms engaged in real estate, environmental, or regulatory practice

**2.3 Consumer Reporting Agency Disclaimer.** VISTAVIEW IS NOT A CONSUMER REPORTING AGENCY AS DEFINED BY THE FAIR CREDIT REPORTING ACT, 15 U.S.C. § 1681 ET SEQ. ("FCRA"). The Service does not constitute, and shall not be used as, a "consumer report" as that term is defined in the FCRA. VistaView provides property and entity intelligence derived from government public records. We do not collect, store, compile, or furnish individual consumer credit histories, credit scores, or creditworthiness assessments. Customer agrees not to use the Service, in whole or in part, as a factor in establishing any individual's eligibility for (a) credit or insurance for personal, family, or household purposes, (b) employment, or (c) any other purpose governed by the FCRA.

## 3. DATA SOURCES AND ACCURACY

**3.1 Public Records Only.** All data provided through the Service is sourced exclusively from official United States government public records. VistaView does not purchase, scrape, or otherwise obtain data from private data brokers, social media platforms, or non-governmental commercial databases.

**3.2 Government Data Sources.** The Service aggregates data from the following official government sources, among others:

- (a) **SEC EDGAR** — Securities and Exchange Commission Electronic Data Gathering, Analysis, and Retrieval system: public company filings, beneficial ownership reports, insider transactions, and corporate disclosures
- (b) **Internal Revenue Service (IRS)** — Tax-exempt organization filings (Form 990), Employer Identification Number registrations, and publicly available tax statistics
- (c) **U.S. Census Bureau** — American Community Survey data, decennial census data, population demographics, housing statistics, economic indicators, and geographic boundary files
- (d) **Federal Emergency Management Agency (FEMA)** — National Flood Insurance Program data, flood zone maps, disaster declarations, National Risk Index, and hazard mitigation data
- (e) **U.S. Geological Survey (USGS)** — Topographic data, seismic hazard assessments, water resource data, land use and land cover classifications, and mineral resource surveys
- (f) **Environmental Protection Agency (EPA)** — Toxic Release Inventory, Superfund site locations, brownfield data, environmental compliance records, and air and water quality data
- (g) **U.S. Department of the Treasury, Office of Foreign Assets Control (OFAC)** — Specially Designated Nationals and Blocked Persons List, sanctions data, and enforcement actions
- (h) **Federal Communications Commission (FCC)** — Broadband deployment data, tower registrations, spectrum license data, and communications infrastructure mapping
- (i) **Federal Deposit Insurance Corporation (FDIC)** — Bank institution data, branch locations, financial performance data, and failed bank records
- (j) **Federal Reserve System** — Economic research data, banking statistics, monetary policy data, and financial stability indicators
- (k) **Bureau of Labor Statistics (BLS)** — Employment data, wage statistics, Consumer Price Index, Producer Price Index, and occupational employment data by region
- (l) **Bureau of Economic Analysis (BEA)** — Gross Domestic Product data, personal income and outlays, regional economic accounts, and industry economic accounts
- (m) **U.S. Department of Agriculture (USDA)** — Agricultural census data, rural development data, crop production data, and farm real estate values
- (n) **State Secretary of State Offices** — Business entity registrations, corporate filings, Uniform Commercial Code filings, and registered agent data across all 50 states and U.S. territories
- (o) **County Assessor Offices** — Property tax assessments, assessed valuations, property classifications, exemption records, and assessment appeals
- (p) **County Recorder Offices** — Deed recordings, mortgage recordings, lien filings, easements, plat maps, and other instruments of conveyance
- (q) **State and local government GIS portals** — Parcel boundary data, zoning designations, land use classifications, and geospatial reference data

**3.3 Data Accuracy.** VistaView strives to provide government-grade accuracy by sourcing data directly from authoritative government records. However, Customer acknowledges and agrees that:

- (a) Data accuracy is dependent on the accuracy of the underlying government records from which the data is sourced.
- (b) Government records may contain errors, omissions, or delays in recording.
- (c) Data update frequency varies by source and jurisdiction: certain federal datasets are updated daily, others weekly, monthly, quarterly, or annually, as determined by the publishing agency's schedule.
- (d) VistaView does not independently verify the accuracy of government records and makes no warranty that the data is free from error.
- (e) Customer is responsible for independently verifying data used in connection with any specific transaction, legal proceeding, or regulatory submission.

**3.4 Data Currency.** VistaView updates its data on regular schedules aligned with the publishing cadence of each government source. Typical update frequencies include:

- Daily: OFAC sanctions lists, SEC EDGAR filings
- Weekly: FDIC institution data, BLS employment updates
- Monthly: Census Bureau economic indicators, EPA compliance data
- Quarterly: BEA economic accounts, Federal Reserve statistical releases
- Annually: Census ACS data, USDA agricultural census, full county assessor rolls

## 4. PERMITTED USE

**4.1 Authorized Business Purposes.** Customer may use the Service and the data provided therethrough solely for legitimate business purposes, including but not limited to:

- (a) Property valuation and comparable market analysis
- (b) Risk assessment and risk scoring for underwriting
- (c) Anti-Money Laundering (AML) and Know Your Customer (KYC) compliance
- (d) Portfolio analysis and asset monitoring
- (e) Market research and investment due diligence
- (f) Fraud detection and prevention
- (g) Title search, title examination, and chain-of-title analysis
- (h) Insurance underwriting and actuarial analysis
- (i) Appraisal analysis and appraisal review
- (j) Investment research and asset allocation
- (k) Environmental risk assessment and due diligence
- (l) Regulatory compliance and reporting
- (m) Entity verification and beneficial ownership analysis
- (n) Lien and encumbrance research

**4.2 Restrictions.** Customer shall not:

- (a) Use the Service for any purpose that violates applicable federal, state, or local law
- (b) Use the Service as a consumer report or for any purpose governed by the FCRA
- (c) Use the Service to make employment decisions about individuals
- (d) Use the Service to stalk, harass, intimidate, or harm any individual
- (e) Resell, sublicense, or redistribute raw data obtained from the Service without prior written authorization from VistaView
- (f) Reverse engineer, decompile, or attempt to extract VistaView's proprietary algorithms, scoring models, or data processing methodologies
- (g) Use automated means (bots, scrapers, crawlers) to extract data from the Platform in excess of the rate limits established for Customer's subscription tier
- (h) Attempt to access data, accounts, or systems beyond the scope of Customer's authorized access
- (i) Remove, alter, or obscure any proprietary notices, watermarks, or attribution included in the Service or its outputs

## 5. INTELLECTUAL PROPERTY

**5.1 Government Data.** Customer acknowledges that the underlying government data aggregated by the Platform is sourced from public records and is generally not subject to copyright protection under United States law. Nothing in this Agreement grants Customer any proprietary rights in the raw government data itself.

**5.2 VistaView Proprietary Rights.** Notwithstanding Section 5.1, Customer acknowledges and agrees that the following are the exclusive intellectual property of VistaView, protected by applicable copyright, trade secret, and other intellectual property laws:

- (a) **Aggregation and Compilation:** The specific selection, arrangement, coordination, and compilation of Government Data within the Platform
- (b) **Derived Intelligence:** All analytics, scores, indices, risk ratings, materialized views, cross-referenced datasets, and other value-added outputs generated by VistaView's proprietary processing
- (c) **Scoring Algorithms:** All proprietary algorithms, models, weighting systems, and methodologies used to generate Derived Intelligence
- (d) **Platform Technology:** All software, code, architectures, interfaces, APIs, database schemas, data pipelines, and technical infrastructure comprising the Platform
- (e) **Presentation and Design:** All visual designs, user interfaces, report templates, data visualizations, mapping interfaces, and graphical presentations
- (f) **Trademarks:** The VistaView name, logo, "Beyond Real Estate" tagline, and all associated marks and trade dress

**5.3 Customer Data.** Customer retains all rights in any data, queries, configurations, or content that Customer uploads to or inputs into the Service. Customer grants VistaView a limited, non-exclusive license to use such Customer data solely for the purpose of providing the Service.

**5.4 Feedback.** If Customer provides suggestions, ideas, or feedback regarding the Service ("Feedback"), VistaView shall have a royalty-free, worldwide, irrevocable, perpetual license to use, modify, and incorporate such Feedback into the Service.

## 6. UNIVERSAL OPT-OUT

**6.1 Right to Request Removal.** Any individual whose personal information appears in the Service may request removal of such information by submitting a written request to:

**6.2 Scope of Opt-Out.** This opt-out right is available to all individuals regardless of their state of residence. It is not limited to residents of California or any other specific jurisdiction. Upon receipt of a valid opt-out request, VistaView will:

- (a) Verify the identity of the requesting individual
- (b) Suppress the individual's personal information from the Platform's outputs within thirty (30) calendar days of verification
- (c) Notify the individual of the completion of suppression

**6.3 Limitations.** Customer acknowledges that suppression of an individual's information from the VistaView Platform does not alter, remove, or affect the underlying government public records from which such information was sourced. The information may continue to be available directly from the originating government agency.

**6.4 Re-Emergence.** If suppressed information re-appears in a subsequent government data update, VistaView will use commercially reasonable efforts to re-apply the suppression. Individuals who have opted out may contact VistaView if they believe their suppressed information has re-emerged.

## 7. SUBSCRIPTION AND PAYMENT

**7.1 Subscription Tiers.** Access to the Service is provided on a subscription basis. Available tiers, pricing, data access levels, API rate limits, and usage parameters are set forth in the applicable Order Form or on the VistaView pricing page.

**7.2 Payment Terms.** Customer shall pay all fees in accordance with the billing frequency and payment method specified in the Order Form. Unless otherwise stated, all fees are due within thirty (30) days of the invoice date. All fees are stated and payable in United States Dollars.

**7.3 Late Payments.** Overdue amounts shall accrue interest at the lesser of one and one-half percent (1.5%) per month or the maximum rate permitted by applicable law. VistaView reserves the right to suspend access to the Service for any account with payment more than fifteen (15) days overdue.

**7.4 Taxes.** All fees are exclusive of taxes. Customer is responsible for all sales, use, value-added, and other taxes applicable to the subscription, excluding taxes based on VistaView's net income.

**7.5 Refunds.** Subscription fees are non-refundable except as expressly provided in the applicable Order Form or as required by law.

## 8. SERVICE AVAILABILITY

**8.1 Uptime.** VistaView shall use commercially reasonable efforts to maintain Platform availability of ninety-nine and five-tenths percent (99.5%) or greater, measured on a monthly basis, excluding scheduled maintenance windows.

**8.2 Scheduled Maintenance.** VistaView may conduct scheduled maintenance during off-peak hours (typically Saturday 2:00 AM – 6:00 AM Central Time). VistaView will provide at least forty-eight (48) hours' advance notice of scheduled maintenance via the Platform status page and email notification to Account Administrators.

**8.3 Unscheduled Downtime.** VistaView shall not be liable for unscheduled downtime resulting from: (a) force majeure events; (b) failures of Customer's equipment, connectivity, or third-party services; (c) government actions or data source outages; (d) cyber attacks, denial-of-service attacks, or similar security events; or (e) Customer's use of the Service in violation of this Agreement.

## 9. CONFIDENTIALITY

**9.1 Definition.** "Confidential Information" means any non-public information disclosed by one party to the other in connection with this Agreement, including but not limited to business plans, pricing, technical specifications, customer lists, and proprietary methodologies.

**9.2 Obligations.** Each party agrees to: (a) hold the other party's Confidential Information in strict confidence; (b) not disclose Confidential Information to any third party without prior written consent; and (c) use Confidential Information solely for purposes of performing under this Agreement.

**9.3 Exceptions.** Confidential Information does not include information that: (a) is or becomes publicly available through no fault of the receiving party; (b) was already known to the receiving party prior to disclosure; (c) is independently developed without reference to Confidential Information; or (d) is rightfully received from a third party without restriction.

**9.4 Compelled Disclosure.** If a party is compelled by law, regulation, or legal process to disclose Confidential Information, such party shall provide prompt written notice to the other party (to the extent legally permitted) and cooperate to obtain a protective order or equivalent.

## 10. DATA SECURITY

**10.1 Security Measures.** VistaView implements and maintains administrative, technical, and physical security measures designed to protect the confidentiality, integrity, and availability of the data processed through the Service. Such measures include, but are not limited to:

- (a) Encryption of data at rest (AES-256) and in transit (TLS 1.2 or higher)
- (b) Role-based access controls and multi-factor authentication for Platform administrators
- (c) Comprehensive audit logging of all data access and administrative actions
- (d) Regular vulnerability assessments and penetration testing
- (e) Incident response procedures and breach notification protocols
- (f) Employee background checks and security awareness training

**10.2 Compliance.** VistaView maintains security practices aligned with industry standards including SOC 2 Type II controls and NIST Cybersecurity Framework guidelines.

## 11. REPRESENTATIONS AND WARRANTIES

**11.1 Mutual Representations.** Each party represents and warrants that: (a) it has the legal power and authority to enter into this Agreement; (b) it will comply with all applicable laws in its performance under this Agreement; and (c) the execution of this Agreement does not conflict with any other agreement to which it is a party.

**11.2 VistaView Warranties.** VistaView warrants that: (a) the Service will perform materially in accordance with the applicable documentation; (b) data provided through the Service is sourced from the government sources identified herein; and (c) VistaView will provide the Service in a professional and workmanlike manner consistent with generally accepted industry standards.

**11.3 DISCLAIMER.** EXCEPT AS EXPRESSLY SET FORTH IN THIS SECTION 11, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." VISTAVIEW DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. VISTAVIEW DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ALL ERRORS WILL BE CORRECTED. VISTAVIEW SPECIFICALLY DISCLAIMS ANY WARRANTY REGARDING THE ACCURACY OR COMPLETENESS OF GOVERNMENT DATA, WHICH IS SUBJECT TO THE LIMITATIONS AND ERRORS OF THE ORIGINATING GOVERNMENT AGENCIES.

## 12. LIMITATION OF LIABILITY

**12.1 EXCLUSION OF CONSEQUENTIAL DAMAGES.** TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EITHER PARTY BE LIABLE TO THE OTHER FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF BUSINESS OPPORTUNITIES, LOSS OF DATA, COST OF PROCUREMENT OF SUBSTITUTE SERVICES, OR INTERRUPTION OF BUSINESS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY (WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

**12.2 CAP ON LIABILITY.** TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE AGGREGATE LIABILITY OF VISTAVIEW FOR ALL CLAIMS ARISING UNDER OR IN CONNECTION WITH THIS AGREEMENT SHALL NOT EXCEED THE TOTAL FEES PAID BY CUSTOMER TO VISTAVIEW DURING THE TWELVE (12) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

**12.3 ESSENTIAL BASIS.** THE LIMITATIONS OF LIABILITY IN THIS SECTION 12 REFLECT AN INFORMED, VOLUNTARY ALLOCATION OF RISK BETWEEN THE PARTIES AND FORM AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN THEM. THE SERVICE WOULD NOT BE PROVIDED WITHOUT THESE LIMITATIONS.

## 13. INDEMNIFICATION

**13.1 Customer Indemnification.** Customer shall defend, indemnify, and hold harmless VistaView, its officers, directors, employees, agents, and affiliates from and against any and all third-party claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) Customer's use of the Service in violation of this Agreement; (b) Customer's use of data obtained from the Service in violation of applicable law, including but not limited to the FCRA; (c) Customer's negligent or wrongful acts or omissions; or (d) any breach of Customer's representations or warranties under this Agreement.

**13.2 VistaView Indemnification.** VistaView shall defend, indemnify, and hold harmless Customer from and against any third-party claims that Customer's authorized use of the Service infringes a valid United States patent, copyright, or trademark of such third party, provided that: (a) Customer promptly notifies VistaView in writing of the claim; (b) VistaView has sole control of the defense and settlement; and (c) Customer provides reasonable cooperation at VistaView's expense.

## 14. TERM AND TERMINATION

**14.1 Term.** This Agreement commences on the date Customer first accesses the Service and continues for the subscription period specified in the applicable Order Form, unless earlier terminated in accordance with this Section 14.

**14.2 Renewal.** Unless either party provides written notice of non-renewal at least thirty (30) days prior to the end of the then-current term, the subscription will automatically renew for successive periods equal to the original subscription term.

**14.3 Termination for Cause.** Either party may terminate this Agreement immediately upon written notice if the other party: (a) materially breaches this Agreement and fails to cure such breach within thirty (30) days of receiving written notice; or (b) becomes the subject of a voluntary or involuntary petition in bankruptcy or any proceeding relating to insolvency, receivership, liquidation, or composition for the benefit of creditors.

**14.4 Termination for Convenience.** Customer may terminate this Agreement for convenience upon thirty (30) days' written notice to VistaView. In such event, Customer shall remain liable for all fees accrued through the effective date of termination. No pro-rata refund shall be provided for the unused portion of a prepaid subscription term.

**14.5 Effect of Termination.** Upon termination: (a) Customer's access to the Service will be immediately disabled; (b) Customer shall immediately cease all use of data obtained from the Service, except as may be retained in Customer's archived records in accordance with Customer's document retention obligations under applicable law; (c) each party shall return or destroy the other party's Confidential Information; and (d) all provisions that by their nature should survive termination shall survive, including Sections 5, 9, 11, 12, 13, and 16.

## 15. COMPLIANCE WITH LAWS

**15.1 General Compliance.** Each party shall comply with all applicable federal, state, and local laws, rules, and regulations in connection with its performance under this Agreement.

**15.2 Export Controls.** Customer shall not export, re-export, or transfer any data or technical information obtained through the Service in violation of the export control laws of the United States, including the Export Administration Regulations (EAR) and sanctions administered by the Office of Foreign Assets Control (OFAC).

**15.3 Anti-Corruption.** Neither party shall, directly or indirectly, offer, pay, promise, or authorize the payment of any money or anything of value to any government official, political party, or candidate for the purpose of influencing any act or decision in connection with the performance of this Agreement.

**15.4 GLBA Compliance.** To the extent that Customer is a financial institution subject to the Gramm-Leach-Bliley Act ("GLBA"), Customer represents that its use of the Service complies with GLBA requirements, including the Standards for Safeguarding Customer Information.

## 16. GOVERNING LAW AND DISPUTE RESOLUTION

**16.1 Governing Law.** This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles.

**16.2 Venue.** Any legal action or proceeding arising under this Agreement shall be brought exclusively in the state or federal courts located in Dallas County, Texas, and each party irrevocably consents to the personal jurisdiction and venue of such courts.

**16.3 Mediation.** Before initiating any litigation, the parties agree to attempt in good faith to resolve any dispute through mediation administered by the American Arbitration Association under its Commercial Mediation Procedures.

**16.4 Attorneys' Fees.** In any action or proceeding to enforce or interpret this Agreement, the prevailing party shall be entitled to recover its reasonable attorneys' fees and costs.

## 17. GENERAL PROVISIONS

**17.1 Entire Agreement.** This Agreement, together with any applicable Order Forms, constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements, proposals, representations, and understandings.

**17.2 Amendment.** VistaView may update these Terms of Service from time to time. Material changes will be communicated to Customer via email to the account administrator's registered email address at least thirty (30) days prior to the effective date of the change. Continued use of the Service after the effective date constitutes acceptance of the updated terms.

**17.3 Assignment.** Neither party may assign this Agreement without the prior written consent of the other party, except that either party may assign this Agreement without consent in connection with a merger, acquisition, or sale of all or substantially all of its assets.

**17.4 Severability.** If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

**17.5 Waiver.** The failure of either party to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.

**17.6 Force Majeure.** Neither party shall be liable for any failure or delay in performing its obligations under this Agreement due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, epidemics, war, terrorism, government actions, labor disputes, power failures, internet outages, or disruption of government data sources.

**17.7 Notices.** All notices under this Agreement shall be in writing and delivered to the addresses specified in the applicable Order Form or, for VistaView, to:

**17.8 Independent Contractors.** The parties are independent contractors. Nothing in this Agreement creates a partnership, joint venture, agency, or employment relationship between the parties.

**17.9 Third-Party Beneficiaries.** This Agreement is for the sole benefit of the parties and their permitted successors and assigns. Nothing in this Agreement confers any rights on any third party, except as expressly provided in Section 6 (Universal Opt-Out).

**17.10 Headings.** Section headings are for convenience only and shall not affect the interpretation of this Agreement.

## 18. ADDENDUM — DEEP AGGREGATION, AMAZON FOREST DISCLAIMER, B2B BARRIERS (DRAFT)

**18.1 Deep USA Parcel Stitch; Public vs Premium Surfaces.** VistaView stitches, normalizes, and indexes United States real-property and related entity intelligence at the parcel / APN / situs level from (a) owned datasets and proprietary joins, (b) government public records and open data, and (c) licensed third-party aggregators where contractually permitted. Premium packs and sealed Deep Stitch exports are offered on a **Business-to-Business** basis. The unauthenticated public surface is limited to legal / public-record information only and does not include skiptrace enrichment or sealed person-level PII downloads.

**18.2 Trademark & Metaphor Disclaimer — “Amazon Forest.”** VistaView may describe its deepest United States parcel-stitch and premium data packs using forest metaphors (including “Amazon forest,” “canopy,” “understory,” and similar imagery) to convey the density and layering of ownership, assessment, geospatial, lien, bankruptcy/court, and other public-record and licensed data joined at the parcel level. Such language is **metaphorical only**. VistaView is not affiliated with, endorsed by, sponsored by, or in any way connected to Amazon.com, Inc., Amazon Web Services, Inc., or any of their affiliates, products, or trademarks. VistaView does not claim any right in the AMAZON mark. Use of forest metaphors does not imply any relationship with Amazon or any Amazon trademark owner. Customers and resellers shall not present VistaView products as Amazon products, Amazon-endorsed offerings, or Amazon Marketplace data products. **18.3 Licensed Aggregator Provenance; No Social Scrape.** Customer acknowledges that certain fields may derive from licensed aggregators under contract, in addition to owned and public-record sources. VistaView does not authorize unauthorized scraping of social-media platforms or other online services in violation of applicable law (including the Computer Fraud and Abuse Act as interpreted by applicable courts) or those services’ terms of service. Person-contact enrichment, where offered, is obtained through permitted channels and remains subject to the access barriers in Section 18.4.

**18.4 Role-Based Access; Clickwrap; VistaSign; Logging.** Skiptrace and other person-level PII lookups and downloads require an authenticated B2B account, acceptance of the applicable data-license clickwrap, and—where downloads occur—acceptance of the VistaSign Data Use Waiver. **Every** skiptrace / PII lookup and sealed download is logged (including actor, timestamp, IP/user-agent, SKU/entitlement, and export or query identifiers as implemented). VistaView may use logs for security, abuse detection, compliance, and dispute response.

**18.5 Ethnicity and Sensitive Attributes — Default Exclude.** Person-level race, ethnicity, religion, and similar sensitive attributes are **excluded by default** from product schemas and exports. Any future offer of such fields requires a separate counsel-approved exhibit, permitted-use attestation, and clear disclosure. Area-level statistical aggregates are not person-level ethnicity lists.

**18.6 Fair-Lending Awareness.** Customer shall not use the Service to engage in unlawful discrimination in housing, credit, or other regulated decisions under applicable fair-lending and fair-housing laws, and shall not misuse area demographic statistics as proxies for prohibited person-level targeting.

**18.7 FCRA / Consumer Reporting — Misuse Prohibition (Reinforced).** Without limiting Section 2.3, and unless counsel determines otherwise in a signed opinion and product redesign, VistaView is not a consumer reporting agency under the FCRA. Customer shall not use the Service (including skiptrace, person-contact, bankruptcy, lien, or court displays) as a consumer report or as a factor in establishing an individual’s eligibility for credit, insurance for personal, family, or household purposes, employment, or tenant screening in any manner regulated by the FCRA.

**18.8 Bankruptcy, Court, Judgment, and Lien Displays.** Such information, when displayed, is presented in a public-record / licensed-record context for property and entity intelligence. Indices may be incomplete, delayed, or conflicting. **Accuracy is not guaranteed.** Customer must verify against official court and recorder sources before legal, financial, or transactional reliance. Displays are not legal advice and are not consumer reports.

**18.9 No Warranty of Completeness.** Without limiting Sections 3 and 11, VistaView does not warrant that any dataset, stitch, score, or display is complete, current, or error-free. Customer must independently verify material facts.

**18.10 Anti-Resale and Injunctive Relief (High-Level).** Unauthorized resale, redistribution, public posting, competing-feed construction, or watermark stripping of VistaView datasets may constitute material breach. VistaView may suspend access, demand certified destruction, and seek temporary, preliminary, and permanent injunctive relief to the extent permitted by law, in addition to other remedies. Liquidated-damages formulas and related enforcement terms are reserved for counsel (`[COUNSEL]`). **18.11 Order of Precedence for this Addendum.** Signed Order Form → VistaSign waiver (downloads) → Data License clickwrap (downloads) → this Agreement (including this Addendum) → marketing copy. Marketing metaphors do not expand license grants.
