These Terms of Service govern access to and use of the VistaView platform at vistaview.ai. By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

1. The Service

VistaView provides property and entity intelligence tools and related account features operated by Vista View Realty Services LLC. Features available to you depend on your account and subscription.

2. Accounts & eligibility

• You must provide accurate information and keep your credentials secure.
• You are responsible for activity under your account.
• You may sign up or sign in on vistaview.ai using email, phone OTP, or supported SSO providers where enabled.

3. SMS OTP authentication & consent

During sign-up / sign-in on vistaview.ai, the flow links to these Terms and the Privacy Policy (“By continuing, you agree to our Terms & Privacy Policy”). After you accept and request a phone verification code, VistaView sends a transactional SMS one-time passcode to the mobile number you entered.

• Purpose: account authentication / identity verification only (not marketing).
• Sample message: VistaView: Your verification code is 123456. It expires in 10 minutes. Reply STOP to opt out, HELP for help.
• Frequency: message frequency varies (typically one message per OTP request).
• Rates: Message and data rates may apply.
• STOP: Reply STOP to cancel further SMS from this program.
• HELP: Reply HELP for help, or email privacy@vistaview.ai.
• Consent to receive OTP SMS is not a condition of purchasing any goods or services.

4. Acceptable use

You agree not to misuse the Service, attempt unauthorized access, interfere with other users, or use the Service in violation of law. We may suspend accounts that violate these Terms.

5. Disclaimers

The Service and data are provided “as is.” VistaView does not guarantee uninterrupted availability or that public-records-derived intelligence is complete or error-free. VistaView is not a consumer reporting agency under the FCRA and the Service must not be used as a consumer report.

6. Limitation of liability

To the fullest extent permitted by law, Vista View Realty Services LLC is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Service.

7. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Courts in Dallas County, Texas, have exclusive venue for disputes arising under these Terms.

9. Bring Your Own Agent, Connected Systems & Lead Sharing

Draft for counsel review. Applies when you use Agent Connect, issue an API key for a third-party agent, or connect an external CRM or data system. Full SPA terms also cover this at /v3/terms#byoa when available.

9(a). Connect Your AI / Agent

• VistaView may let you connect a third-party AI or agent (“Your Agent”) using scoped API keys (e.g. vs_live_). Your Agent receives only allowlisted API access — never VistaView source code, admin credentials, or unrestricted database access.
• You are responsible for Your Agent’s use of the Service under your account. Keys may be rate-limited, scoped, audited, and revoked at any time.
• Write / act tools (if offered) require VistaView’s internal review before enablement and may require human confirmation for sends, payments, or publications.

9(b). Connected CRMs and data systems (consent)

• If you choose Connect on a CRM or similar system, you authorize VistaView to access the fields and scopes shown on that Connect screen (and any OAuth consent screen from the provider).
• You grant VistaView a worldwide, royalty-free license to ingest, store, process, enrich, correct against VistaView’s own datasets, and use that Connected Data to operate and improve the Service.
• Connected Data remains subject to our Privacy Policy. You may disconnect; we will stop new pulls and honor deletion requests for your Connected Data copies as described in Privacy / CCPA tools, except where retention is required by law or for fraud/security.
• You represent you have rights to connect that system and to share the data with VistaView (including any required notices to your customers/contacts).

9(c). Lead sharing & VistaView Points

• Where you opt in to Share leads, you may share qualified leads with VistaView and/or other VistaView professionals under program rules we publish.
• Shared leads may earn VistaView Points toward features, recognition, or other benefits we define. Points have no cash value unless we expressly say otherwise; we may adjust earning rates, expire points, or end the program with notice.
• By sharing a lead you grant VistaView the right to contact that lead (subject to TCPA/CAN-SPAM and our permitted-use rules), attribute the share for Points, and use lead metadata to improve routing and marketplace quality. You must only share leads you are lawfully allowed to share.
• VistaView may retain shared-lead records for compliance, fraud prevention, and program integrity even after you leave the Points program.

9(d). House IP & no reverse engineering via Agent

Using Your Agent or Connected Systems does not grant you a license to VistaView’s software, models, training data, or proprietary datasets beyond the scoped API responses. You will not use Agent Connect to exfiltrate bulk data beyond rate limits, reverse engineer our systems, or circumvent access controls.
